1. Introduction

Welcome to 1bee AI SDR. These Terms of Service ("Terms") govern your use of our service located at https://1bee.ai ("Service") operated by 1bee AI ("Company", "we", "our", "us"). By using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not use our Service.

2. Description of Service

1bee AI SDR provides you with access to an AI-powered Sales Development Representative (SDR) which can be accessed via a web interface. The Service may include certain communications from us, such as service announcements and administrative messages. Any new features or tools added to the Service shall also be subject to these Terms.

3. Registration and Use of Service

To use our Service, you must be of legal age to form a binding contract. You agree to provide true, accurate, current, and complete information about yourself as prompted by the Service's registration form. You are responsible for maintaining the confidentiality of your account and password.

Your login may only be used by a single user. A single login shared by multiple users is not permitted. We reserve the right to cancel or suspend your access to the Service if we detect any suspicious activity that suggests you have willingly and/or knowingly shared your credentials with another user.

4. Intellectual Property

The Service and its original content, features, and functionality are owned by 1bee AI and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You may not copy, modify, create derivative works of, publicly display, publicly perform, republish, or transmit any of the material on our Service without prior written consent.

All materials and all intellectual property rights in respect of the Services provided therein (including all underlying technology, modifications and work products created in or arising from the same) shall remain the property of 1bee AI and nothing shall operate as a transfer of such rights.

5. User Responsibilities and Prohibited Uses

You agree not to use the Service:

• In any way that violates any applicable national or international law or regulation.
• To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter," "spam," or any other similar solicitation.
• To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity.
• In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity.
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which, as determined by us, may harm 1bee AI or users of the Service or expose them to liability.

Additionally, you agree not to:

• Use the Service to build a similar or competitive product or service.
• Use any robot, spider, or other automatic device, process, or means to access the Service for any purpose, including monitoring or copying any of the material on the Service.
• Use any manual process to monitor or copy any of the material on the Service or for any other unauthorized purpose without our prior written consent.
• Use any device, software, or routine that interferes with the proper working of the Service.
• Introduce any viruses, trojan horses, worms, logic bombs, or other material which is malicious or technologically harmful.
• Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service.
• Attack the Service via a denial-of-service attack or a distributed denial-of-service attack.

6. Data Privacy and Security

Your use of the Service is also governed by our Privacy Policy, which can be found at https://1bee.ai/privacy. By using the Service, you consent to the collection and use of your information as detailed in our Privacy Policy.

We may anonymize and aggregate any data you share with the Service and use it without identifying you for purposes of improving the Service.

7. Payments, Subscriptions, and Fees

If you choose a paid subscription to our Service, you agree to pay all fees associated with the plan you choose. Fees are non-refundable except as required by law or as explicitly stated in these Terms. You authorize us to charge your chosen payment method for the fees associated with your subscription.

All fees are exclusive of taxes, which we will charge as applicable. You are solely responsible for any applicable taxes and fees. If you are exempt from any taxes and fees, you must provide us with all appropriate tax exemption certificates or other documentation satisfactory to the applicable taxing authorities.

8. Refund Policy

Unless required by law, 1bee AI is not obligated to provide you a refund at any time or for any reason.

9. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. Upon termination, your right to use the Service will immediately cease.

You may choose to cancel your subscription by providing written notice at least five days ahead of renewal. Unless stated or agreed otherwise in writing, all contracts automatically renew at the end of the initial term.

10. Modifications to Service

We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service.

11. Limitation of Liability

In no event shall 1bee AI, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

To the extent permitted by law, the total liability of 1bee AI for any claim under these Terms, including for any implied warranties, is limited to the amount you paid us to use the Service in the 12 months preceding the claim (or, if we choose, to supplying you the Service again).

12. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

1bee AI does not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which 1bee AI is established, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

15. Indemnification

You agree to indemnify, defend and hold harmless 1bee AI and its licensees, licensors, employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your use of the Service has caused damage to a third party.
